Introduction

This mobile application (the AC Global Travel Driver “App”) is made available by AC Global Travel, registered with CNPJ: 17.192.150/0001-47 at Rua Alexandre Buaiz, 300, 20th floor, Enseada do Suá, Vitória (ES) , Brazil. The mobile application (APP) was designed for use on iOS and Android smartphones, it is mainly intended to allow drivers and homologated partners to carry out jobs that are allocated according to their availability and geographic location.

General

These Terms and Conditions of use apply to drivers and homologated partners that allow users to be monitored during their displacement with the aid of GPS technology and to register their details and, once verified, these registered users can log in, notify the subscriber that they are available and upon assignment can carry out work for AC Global Travel. By installing the APP, the subscriber agrees to be bound by these terms and conditions of use which must be read and understood prior to installation, and which may be updated from time to time. Users of this APP may not modify, copy, publish, sell, transfer rights, or use this APP for any purpose other than facilitating your activities with AC Global Travel. You, APP user, confirm your acceptance of these APP terms and conditions. If you do not agree with these APP Terms, you must immediately uninstall the APP and stop using it.

Using the APP

You are aware that, according to the Road Traffic Law, the use of mobile phones while driving a moving vehicle is prohibited. By law, as mentioned in the Sole Paragraph of Article 252 of the New Brazilian Traffic Code (CTB), a driver who holds or handles a cell phone while driving is committing a very serious infraction. AC Global Travel requests and recommends that all APP users use it only when the vehicle is parked and stopped with the engine off. Failure to comply with these regulations will make you liable to prosecution by authorities, which could result in you losing your driver’s license and receiving a substantial fine. AC Global Travel is not responsible for mishandling the mobile phone. We suggest that there are ‘hands free’ kits on the market and it is highly recommended to be used or handled while parked or stopped in a safe location.

Prohibited Uses

User agrees not to use the App in any way that is unlawful, unlawful or unauthorized.

To uninstall the APP, please use the application manager provided in your device or refer to your device manual for reference.

Costs

The APP download is free for drivers and partners. The registered user is responsible for all charges incurred with the mobile carrier and/or internet service provider as a result of using the APP.

Intellectual property

All trademarks, copyrights, database rights and other intellectual property of whatever nature in the APP, together with the underlying software code, are owned by AC Global Travel. Users do not acquire any rights and/or interest in the APP through the use.

Availability

The APP is available on Apple iOS and Android operating systems. Software requirements are devices on Apple iOS running iOS 21.1 and Android OS devices running Android OS 5.0 to 11 in English and Portuguese language. The APP is designed for use on smartphones. AC Global Travel is not responsible for the unavailability of the APP, for any difficulty in downloading, installing, or accessing information or for any failure of the communication system that may result in the unavailability of the APP. AC Global Travel may occasionally need to take the service utilized by the APP offline to improve service or to perform routine maintenance. During these periods, the APP will not be able to retrieve any information. In addition to the above mentioned. AC Global Travel will not be responsible for any support or maintenance of the APP.

Data

Personal information and data are protected with security and confidentiality measures, to protect our customers, users and visitors from unauthorized access and situations of destruction, loss and alteration. Still to provide our users with a safe and reliable environment, we use technologies and cryptography, which guarantee the transmission of data in a safe and confidential way, all to maintain the integrity, confidentiality and security of your information. AC Global Travel uses applications hosted on partner and approved servers to carry out its operations. Data and information are stored in our databases, during the period necessary to comply with the provisions of item I, article 15, of Law No. law demand other treatment and the provisions set out in Article 16 of said Law. All information and data collected on the website and application will be stored in our database, without any human interference. In addition, all analyses carried out with your individual information will also be done by electronic processing and the results presented will always be statistical summaries, in which your name will be kept confidential. The information that is provided when registering as a driver or partner includes: name, gender, date of birth, physical address, contact information such as telephone number and email address, all your driving documents and all details and documents for your vehicle. As well as bank details for payment of the service provided. By downloading the AC Global Travel Driver APP, the user agrees to receive the OTP variation on his registered mobile number to log in to the application.

Limitation of Liability

In no event will AC Global Travel be liable for any direct or indirect loss or damage arising out of your use of or access to the APP, including, but not limited to, any damage or alteration to your equipment, including, but not limited to, cell phones, smartphones or other portable devices as a result of installing the APP.

GPS Tracking

We collect the minimum information necessary only for the GPS tracking service. Background location is used to track the driver’s location so that AC Global Travel’s administrative system can see where the driver is. AC Global Travel may collect GPS (Global Positioning System) location information from the cell phones of partner drivers and users. Licensed drivers’ location information can be captured when the driver app is running on the driver’s cell phone during trips, as long as the driver is logged in to receive trips. When you sign up for the Driver app, you will receive a request on your device asking permission to share information about your location, including geolocation data collected via Bluetooth and nearby Wi-Fi. This information includes location data collected via bluetooth and nearby Wi-Fi signals. By default, and to ensure the best service available, the AC Global Travel driver app prompts the user to enable the “Allow only when using the app” location services option. We use location data to monitor partner drivers. We also use them to view travel history on your receipts, understand and resolve support contacts, as well as troubleshoot software issues and bugs, and report to customers. In device settings, users have the option to opt out of collecting GPS location information, and if they choose this option, that user data will not be captured. On devices, you will have 3 location setting options:

Allow all the time: We will collect location information at any time, even when you are not actively using the AC Global Travel Driver app. If a service needs access to the “Allow all the time” option, we will ask for your permission when you activate the service.

Allow only when using the app: We will collect location information when the app is visible on the screen, when you have requested a ride, or while traveling. If set to “While using the app”, notifications will constantly appear on the device whenever location data is collected in the background.

Deny: This option disables the AC Global Travel driver app’s location services. To use the app, you must manually enter the departure and destination locations. Even if location services are disabled in your app, location information will be collected from the partner driver app during the trip and linked to your account.

Changes to the Terms of Use

AC Global Travel may vary these terms from time to time, such variations will be posted on the AC Global Travel website and such variations will be effective one month after posting. The user must check the website regularly, as he will be considered to have accepted such variations if he continues to use the APP after they have been posted on the website.

Termination

AC Global Travel may cancel or terminate your use of the APP at any time, for any period, without prior notice. Upon termination for any reason, you will cease to use the APP.
